These Terms and Conditions govern your access to and use of Piqura, a web-based photo and video sharing service operated by ES Contracting and Procurement ("we", "us", or "our"). By using Piqura, you agree to these terms. If you do not agree, please do not use the service.

1. The Service

Piqura is a web service that allows event organisers ("Organisers") to create private albums and invite participants ("Members") to upload and view photos and videos. The service is accessed entirely through a web browser - no software installation is required.

Piqura is currently offered free of charge during its testing phase. We reserve the right to introduce pricing in the future, with reasonable notice provided in advance.

2. Accounts and Access

Piqura does not require Members to create an account. Access is granted via a unique event URL and a 4-digit PIN shared by the Organiser. Organisers are responsible for keeping their admin PIN confidential and for controlling who receives the guest PIN.

You must be at least 16 years old to use this service. By using Piqura, you confirm that you meet this requirement.

3. Uploaded Content

You retain ownership of any photos or videos you upload. By uploading content, you grant us a limited licence to store, display, and serve that content solely for the purposes of operating the service for the event you are participating in.

You must not upload content that:

• Infringes the intellectual property rights of others
• Contains nudity, explicit material, or content that is offensive, defamatory, or illegal
• Depicts minors in any inappropriate context
• Contains malware, viruses, or any harmful code

The Organiser has full moderation control and may remove any content at their discretion. We reserve the right to remove content and suspend access for violations of these terms.

4. Privacy and Data Retention

We take privacy seriously. Key commitments:

• GPS and device metadata (EXIF data) is automatically stripped from all uploaded photos
• All photos, videos, and associated data are automatically and permanently deleted at the end of the event's retention period (typically 7-90 days)
• We do not sell, share, or use your content for advertising or analytics
• Members may request removal of their uploaded content at any time by contacting the Organiser or us directly

5. Organiser Responsibilities

Organisers are responsible for:

• Ensuring they have appropriate consent from Members before sharing the event PIN with them
• Moderating uploaded content and removing anything inappropriate
• Informing Members about how their photos will be used and stored
• Downloading their content before the event's retention period expires

6. Service Availability

We aim to keep Piqura available at all times but cannot guarantee uninterrupted access. We may suspend or discontinue the service at any time, including for maintenance, security, or business reasons. We will endeavour to provide reasonable notice where possible.

During the current testing phase, events may be subject to upload limits and shorter retention periods. These restrictions will be communicated clearly on the platform.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ES Contracting and Procurement shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including loss of data, loss of content, or service interruptions.

You are solely responsible for downloading and backing up your content before the retention period expires. We do not accept liability for content lost due to expiry or service termination.

8. Indemnification

You agree to indemnify and hold harmless ES Contracting and Procurement, its officers, and employees from any claims, damages, or costs arising from your breach of these terms or misuse of the service.

9. Modifications to These Terms

We may update these terms from time to time. Material changes will be communicated at least 14 days in advance via the platform or by email where we hold your contact details. Continued use of the service after changes take effect constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
